Terms used
The “Company” means clickety click ltd, a limited company registered in England with registered offices at Redlands, St Mary's Road, Worcester Park, Surrey KT4 7JL, United Kingdom.
The “Client” means the person whose name appears on the booking form.
The contract
The purchase of any tour services offered by the Company constitutes a contractual arrangement between the Client and the Company and represents the Client’s acceptance of the Company’s terms and conditions set out herein. The Client is requested to carefully read and understand these terms and conditions prior to booking.
The contract is made only when the Company receives a non-refundable £250 deposit and a signed booking form and the Company issues a confirmation invoice.
A contract is made between the Company and all those listed on the booking form. The person who signs the booking form does so on behalf of all those listed on the form and is responsible for all those listed having read the terms and conditions and having agreed to abide by them.
The Company reserves the right to decline any booking at its discretion. Furthermore the Company reserves the right to cancel any booking at any time at its sole discretion in the event that the Company considers the Client to be unsuitable for the tour booked.
The contract, including all matters arising from it, is subject to English law and the exclusive jurisdiction of the English courts.
Payments
Basis of rates: all prices are based on two persons sharing a room or cabin. All prices are quoted in British pounds sterling (GBP). Single-room accommodation is subject to availability and supplements shall apply.
A non-refundable deposit of £250 for each person is required when submitting the booking application form. The booking fee is accepted as part of the inclusive price and will be refunded only if the Client cannot be accommodated. Please note that reservations cannot be made without a deposit.
The full amount due by the Client to the Company shall be payable not less than eight weeks prior to the date of departure. If the full amount is not paid in due time, the Company reserves the right to treat the booking as cancelled and retain the full deposit. Late applicants, however, may join the tour on an “accommodation available” basis and will be required to pay the full amount upon booking.
Participation and eligibility
Anyone under 18 must be accompanied by a parent or guardian for the entire trip.
For the benefit of all tour participants, the Company reserves the right to accept or reject any participant and to remove any participant whose conduct is deemed incompatible with the interests of the other participants. The Company will not refund or cover any cost or expenses incurred if it has to terminate the Client’s vacation arrangements due to the latter’s unacceptable behaviour.
Insurance
Comprehensive travel and medical insurance is compulsory for tour participants booking with the Company. The Client acknowledges that it is his/her responsibility to take out insurance. The Client undertakes to take out comprehensive travel insurance to cover his/her personal requirements. This insurance should include cover in the respect of, but not limited to, the following eventualities: cancellation and curtailment of the services booked, emergency evacuation expenses, medical expenses, repatriation expenses, damage/theft/loss of personal baggage, money and goods. The Company will take no responsibility for any costs, losses incurred or suffered by the tour participants with regard to, but not limited to, any of the above-mentioned eventualities. Tour participants will be charged directly by the relevant service providers for any emergency services they may require.
It is advisable that extra insurance be taken out to cover computer and camera equipment.
Cancellations and cancellation fees
Cancellations are effective only on receipt of written notification. If a booking is cancelled prior to eight weeks before departure, the Client forfeits his/her deposit. If the booking is cancelled less than eight weeks before departure, the Company shall retain the full deposit and a cancellation fee will be payable by the Client as follows:
55 - 29 days: deposit plus 25% of total fare
28 - 22 days: 50% of total fare
21 - 14 days: 75% of total fare
13 - 0 days: 100% of total fare
Cancellation insurance is compulsory for all participants. It is the Client's responsibility to arrange cancellation insurance. Should a Client fail to join a tour after a departure or leave prior to its completion, no refund or liability will be accepted by the Company.
The Company regrets that individual tour departure dates will operate only when booked by a sufficient number of passengers. The Company reserves the right to cancel any departure date that has insufficient demand. It also reserves the right to cancel or reschedule any vacation departure for any reason. If a tour is cancelled prior to departure, the Company’s only responsibility will be to refund participants the amount received for the reservation. The Company will endeavour to rebook the same tour with a different departure date, or a similar tour.
The Company cannot assume responsibility for any additional costs or any fees relating to the issuance and/or cancellation of air tickets or other travel arrangements not made through the Company.
The Company is not responsible if an airline cancels, reschedules, or delays a flight for any reason. If the Client misses his/her departure flight, it is the Client’s responsibility to work with the airline on which he/she is ticketed to reach the destination. The Company is not responsible for any additional expenses the Client may incur prior to joining the trip. The Company is not responsible for and will not provide any refund for portions of trips missed due to cancelled, rescheduled or delayed flights.
Once the tour has started, no refunds will be made under any circumstances for any unused sector(s) or section(s). No refunds will be made for inclusive activities not undertaken by the Client. No inclusive activity is refundable for cash, or transferable to another person.
Indemnity
The Company shall not be held liable for any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider; and any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond its control. The Client waives any claim against the Company for any such loss, damage, injury, or death.
Neither the Company nor any person or agent acting for, through or on behalf of the Company shall be liable for any loss or damage whatsoever arising from any cause whatsoever and, without restricting the generality of the aforegoing, shall particularly not be responsible for loss or damage arising from any errors or omissions contained in its website, literature or information sources, loss or damage caused by delays, sickness, theft, injury or death.
In addition the Company shall have the right at any time at its discretion to cancel any services or the remainder thereof or make alterations in route, accommodation, price or other details and, in the event of any services being rendered impossible, illegal or inadvisable by weather, strike, war, government or interference or any other cause whatsoever, the extra expenses incurred as a result thereof shall be the responsibility of the participants.
The Client acknowledges that the services arranged by the Company, whether in civilised or remote areas, contain inherent risks of injury, illness, death, or loss and damage to property, which may be caused by forces of nature, accidents, wild animals, negligence of others, and other causes known or unknown. The Client acknowledges that such risks may be present at any time before, during or after the tour arranged by the Company and that medical services and facilities may not be readily available during the tour. The Client expressly assumes any and all risks with respect to the activities and circumstances described herein and agrees not to sue the Company on account of any losses, claims, costs, liabilities or damages. The Client agrees not to allege the unenforceability of the present contract or part thereof. In the event of any competent authority finding that any portion of the present contract is unenforceable, the remaining portion shall remain in full force and effect. The Client agrees that the aforegoing obligation shall be binding.
Health
The Client acknowledges being aware of the proposed itinerary and it is the Client's obligation to ensure that he/she is medically fit and able to embark upon such a tour.
By registering for a tour, the Client certifies that he/she does not have any mental, physical, or other condition or disability that would create a hazard for him/herself or other participants. The Company reserves the right in its sole discretion to accept, decline to accept, or remove any tour participant. The Company reserves the right, without penalty, to make changes in the published itinerary whenever, in its judgment, conditions warrant, or if it deems it necessary for the comfort, convenience, or safety of participants.
Travel documents
The Client acknowledges that it is his/her responsibility to ensure that he/she is in possession of the necessary valid travel documents, passport, visas, vaccination certificates, etc. Despite the fact that the Company will endeavour to assist tour participants in this regard, such assistance should be at the Company's sole discretion. The Client acknowledges that in so doing, the Company is not assuming any obligation or liability, and that nevertheless the responsibility to ensure that the aforesaid documentation is in order and complies with such lawful and other requirements to enable the Client to enjoy the benefits of the tour, remains the Client's.
The Client acknowledges that the Company will not be held liable to a refund of the tour fare or compensation, should the Client be refused entry into a country for any reason.
Baggage Allowance
Porterage for one suitcase or backpack (up to 25kg) is included in the tour price, in addition to a carry-on bag containing camera equipment and the like. The Company regrets that it is unable to accept a second piece of baggage.
No responsibility is accepted for the loss of or damage to baggage or any of the tour participant’s belongings throughout the duration of the tour. Baggage and personal effects are at all times the sole responsibility of the participant. Baggage insurance is recommended.
Photography
The Company reserves the right to take photographs or videos during the operation of any expedition or part thereof and to use the resulting photography and/or video footage for promotional purposes. By making a reservation with the Company, participants agree to allow their images to be used in such photography; participants who prefer that their image not be used are asked to identify themselves at the commencement of their trip.
The Company also reserves the right to use any comments participants make regarding the tours on any questionnaires or letters in future promotional literature.
Complaints
Any complaint or claim involving the tour services must be notified to the Company within 30 days of completion of the tour. All correspondence must be forwarded in writing to clickety click ltd, Redlands, St Mary's Road, Worcester Park, Surrey KT4 7JL, United Kingdom. As it is difficult and sometimes impossible to properly investigate a complaint if the Company is not advised of such complaint quickly, any compensation the Client may have been able to claim could be reduced or even forfeited if the Client does not follow the complaints procedure set out in this clause.
Service inquiries after the tour
After returning from the tour, if the Client wishes to inquire about any services provided, he/she should ensure that all correspondence relating to those services is forwarded to clickety click ltd, Redlands, St Mary's Road, Worcester Park, Surrey KT4 7JL, United Kingdom.
